I called the police and since neither of us have custody and since he is the biological father, he has rights to take her wherever he wants. I went to the court house to file a petition for custody but they can't file a petition unless they have an address to serve the petition. He won't give me his address or where he lives.

Not sure what country you live in. What do you mean neither has custody? As the mother you can ask the cops to treat this as a kidnapping since he disappeared with her. If he took her and is keeping her away from you without legal recourse then that child is kidnapped. I call BS on this one.

It does happen quite often. I'm very soory for your loss. What state is this? I've met many moms whose children were stolen by pedophile and psychpath fathers, CPS and foster parents with NO recourse to the law. It's all pay to play with family courts.
